On March 29, 2023, the Commercial Court of the city of Kyiv opened proceedings in the case of the lawsuit of the Holy Dormition Kyiv-Pechersk Lavra (Men's Monastery) of the Ukrainian Orthodox Church against the National Reserve "Kyiv-Pechersk Lavra" regarding the illegal termination of the contract by the Reserve. This was reported by the lawyer of the monastery Archpriest Mykyta Chekman, the Information and Education Department of the Ukrainian Orthodox Church reports.
The lawsuit states the need to prohibit the "Kyiv-Pechersk Lavra" Nature Reserve from taking any actions aimed at hindering the religious community during the trial.
In addition, the court also granted Monastyr's request to request evidence, which the latter repeatedly tried to obtain from the Cabinet of Ministers of Ukraine, the Ministry of Culture and Information Policy of Ukraine, and the State Audit Service of Ukraine, but access to the information requested by the Religious Organization was limited.
Earlier, Archpriest Mykyta said that the monastery and its representatives made legal requests to these departments, trying to find out about the results of the Interdepartmental Working Group, which allegedly established the violation of the terms of the contract by the monastery.
The departments did not provide information, citing the fact that the conclusions are marked "For official use". That is, the alleged main reason for the eviction is not confirmed by anything, the Church was deprived of the opportunity to provide an explanation or refutation, thus violating its rights.
"We inform you that the preparatory meeting in the case is scheduled for 04/26/23 at 11:00 a.m. in the premises of the Commercial Court of the city of Kyiv at the address: Kyiv, str. Bohdana Khmelnytskyi, 44-B, hall No. 17. We pray for the restoration of the violated rights of the parishioners of the Ukrainian Orthodox Church and the adoption of a fair court decision," the lawyer said.
